1. Agreement to Terms

By downloading, installing, or using Q ("the app"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app.

2. Description of Service

Q is a live AI dating coach application that provides real-time coaching cues through your earpiece during in-person conversations. The app also provides post-session scoring, feedback, conversation transcripts, and progress tracking.

Q is a tool designed to help you improve your social and conversational skills. The coaching provided by Q is generated by artificial intelligence and should be treated as suggestions, not instructions. You are solely responsible for your own words, actions, and behavior during any interaction.

3. Eligibility

You must be at least 17 years old to use Q. By using the app, you confirm that you meet this age requirement.

4. Acceptable Use

You agree to use Q only for lawful purposes and in a manner that respects the rights and dignity of others. You agree not to:

• Use Q to harass, intimidate, stalk, or threaten any person
• Use Q in any situation where recording audio is prohibited by law
• Use Q to deceive or manipulate others in a harmful way
• Rely on Q as a substitute for professional advice (psychological, legal, or otherwise)
• Attempt to reverse-engineer, modify, or exploit the app or its systems
• Use Q in any way that violates applicable local, state, national, or international laws

5. Audio Recording and Consent

Q accesses your device's microphone during coaching sessions. You are responsible for understanding and complying with all applicable laws regarding audio recording in your jurisdiction. Many jurisdictions require the consent of all parties before recording a conversation. Q is designed as a live coaching tool — it is your responsibility to ensure your use of the app complies with local recording and wiretapping laws.

6. AI-Generated Content

All coaching advice, scores, feedback, and analysis provided by Q are generated by artificial intelligence. This content is provided "as-is" and for informational and entertainment purposes only. We make no guarantees about the accuracy, quality, or appropriateness of any AI-generated content. You acknowledge that:

• AI coaching may sometimes be irrelevant, poorly timed, or incorrect
• Scores and feedback are subjective estimates, not objective measurements
• The "reply chance" metric is a rough estimate and not a guarantee of any outcome
• Q is not a licensed therapist, counselor, or professional coach

7. Privacy

Your use of Q is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using Q, you agree to the terms of our Privacy Policy.

8. Intellectual Property

Q, including its design, code, AI models, content, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the app without our written permission.

9. Subscriptions and Payments

Q may offer subscription plans or in-app purchases. If you purchase a subscription:

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your device's Settings → Apple ID → Subscriptions
• No refunds are provided for any unused portion of a subscription period

10. Disclaimer of Warranties

Q is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components. We do not warrant that the AI coaching will be accurate, helpful, or appropriate for any particular situation.

11. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Q. This includes but is not limited to damages arising from: any interaction or conversation you have while using Q, reliance on AI-generated coaching or feedback, any emotional distress or social consequences resulting from your use of the app, or any loss of data.

Our total liability for any claim arising from your use of Q shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of Q, your violation of these terms, or your violation of any third party's rights.

13. Termination

We reserve the right to suspend or terminate your access to Q at any time, for any reason, without notice. You may stop using Q at any time. Upon termination, your right to use the app ceases immediately.

14. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms within the app or on our website. Your continued use of Q after changes are posted constitutes acceptance of the revised terms.

15. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
